By downloading, installing, or using Phonique (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Phonique is a mobile application that helps users learn and practice French verb conjugations through spaced repetition and daily practice.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old.
The App may use anonymous identifiers for subscription management. You are responsible for maintaining the security of your device and any associated accounts.
The App offers premium subscriptions that provide access to additional features:
Prices may change based on regional app store availability.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.
Refund requests are handled by Apple. Contact Apple Support for refund inquiries.
The App may offer a free trial period. The trial will automatically convert to a paid subscription unless cancelled before the trial period ends.

All content, features, and functionality of the App are owned by David McQueen and are protected by international copyright, trademark, and other intellectual property laws.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, David McQueen SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
You agree to indemnify and hold harmless David McQueen from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. However, if you are a consumer residing in the European Union, you may benefit from the mandatory provisions of the consumer protection laws of your country of residence.
If you are a consumer residing in the European Union, you may use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes. The ODR platform is available at: https://ec.europa.eu/consumers/odr/
You also have the right to bring proceedings in the courts of your country of residence or in the courts of France.
Any disputes arising out of or relating to these Terms or the App that cannot be resolved through the ODR platform (for EU consumers) or through direct communication shall be subject to the exclusive jurisdiction of the courts of France.
Before initiating any formal dispute resolution process, we encourage you to contact us directly to attempt to resolve any issues amicably.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
